The Role of Family Mediation in Florida Divorces
All parties to a divorce in Palm Beach County, Florida, must attend mediation. Like collaborative divorce, mediation is a method of alternative dispute resolution (ADR) used to help parties settle their divorce issues outside of court. This process is generally less expensive and less emotionally destructive to the parties involved because the parties "agree to agree."
In Palm Beach County, you have the option to choose between working with a private mediator or a court mediator. We prefer to work with private mediators, as most are retired judges or retired family law practitioners. They already have the necessary legal background to bring something more to the mediation table.
How the Divorce Mediation Process Works
During the divorce mediation process, you will meet with your spouse and your chosen mediator. Each spouse is allowed to bring his or her own legal counsel and various documents. At any moment, either party is allowed to walk away from the negotiations.
The whole process could take as little as 10 minutes if one of the parties is unable or unwilling to negotiate. However, the process could also take five hours or five days. If it does take longer, this usually means you are able to come to a global agreement.
At the end of a productive mediation, you can walk out with a legal marital settlement agreement that will become part of your final divorce decree. This settlement agreement will include all matters pertaining to your divorce, including:

If anything offered in mediation is what you would get in court or better, we will advise you to accept this offer. It is always your decision as to which route you want us to take on your behalf. All exchanges in mediation are confidential settlement negotiations and cannot be used against you should you need to go to court.
