HOW TO GET A DIVORCE WHEN YOU CAN'T SELL THE MARITAL HOME
In today's depressed real estate market, many divorcing couples don't realize that they have options if they can't sell the marital home.
There are several ways:
1) Get divorced, let one spouse and children stay there (as tenants in common with the other spouse, i.e. a partnership) until the youngest child reaches age of majority, then sell. This can be stated in a marital settlement agreement.
2) One spouse buys out the other through refinancing.
3) Both spouses put the home on the market and either sell at fair market value and pay off the note, OR IF THE HOUSE IS UPSIDE DOWN, worth less than the mortgage, do a SHORT SALE.
